Springing Durable Powers of Attorney

A Springing Durable Power of Attorney is different from a Durable Power of Attorney in that it only “springs” into effect when a doctor provides an affidavit that due to a medical condition, an individual is unable to make or communicate reason decisions regarding their care. 

When Documents are Used

These documents are used in a case where someone is wishing to give someone else a Power of Attorney but do not want it to be effective until such a disability occurs. This allows for a person to ensure that a person isn't allowed to make decisions until the property owner cannot do it for themselves.
