Disputes, regrettably, often arise. Resolving those disputes is what we do. “Civil litigation” refers, essentially, to lawsuits between private persons (as opposed to, for example, criminal disputes). Damage Suits and Litigation
Lawsuits are filed for any number of reasons. The single, most common, however, is that someone believes that the action or inaction of another (or others) has caused them damage. They seek relief in some fashion. Whether you are seeking to obtain relief in a lawsuit (a plaintiff) or whether you are defending a lawsuit that has been filed against you (defendant), Hoyt & Stanford has extensive litigation experience and we can assist you.
Property Disputes and Litigation
Property disputes can take many forms. Often, co-owners of property will seek to partition that property, i.e., divide it up between them, so they each get their share. Depending on the property, perhaps it can be literally divided, or perhaps the only solution is to sell the property and split the proceeds. In either case, experienced legal assistance is a must.
Other matters may involve boundary disputes between adjoining landowners, or any number of other disputes that might arise over property. In any event, we are prepared to offer our assistance.
Contract Disputes and Litigation
Contracts are nothing more than agreements. Unfortunately, it is exceedingly common that the parties to a contract often disagree as to their respective rights or obligations. Equally common, one party feels the other has failed to meet their obligations. Such disagreements often result in disputes and resulting litigation. When an individual dies, Louisiana law governs what becomes of their estate. Whether a person passes leaving a will (“testate”) or without (“intestate”) any number of disputes can, and often do, arise. From whether there is a will, or its validity, to the management of the estate, to who are and aren’t the heirs/legatees, there are a myriad potential conflicts to be dealt with. Partnership and Corporate Litigation
People have disagreements. Not surprisingly, so do the businesses and organizations they form. Under Louisiana law, certain such entities are treated as “juridical persons”, or people under the law. As we have extensive experience in forming such entities, likewise we are experienced in the various disputes that arise. In many such cases these entities are closely held, among friends or family members, and the disputes can be, well, akin to a divorce. In such instances you need competent and experienced representation and we can provide it for you.
Unfair Trade Practices
Unfair trade practices are a particular aspect of the law. The law says “unfair methods of competition and unfair or deceptive acts or practices in the conduct of any trade or commerce are hereby declared unlawful”. In addition, a private right of action is available in the event of alleged damages arising from such conduct. As one might imagine, the potential for disputes and litigation is quite broad. Open Account Litigation
